Costs are always in the discretion of the Court, however costs usually ‘follow the event’ meaning the successful party’s costs are paid by the unsuccessful party.
In certain circumstances, the Court may make a special costs order – including an order for partial payment of costs, an order that each party pay their own costs, an order for payment of costs on an indemnity basis or an order that costs be paid in a lump sum rather than as agreed or assessed.
